What this Warranty Covers
Swift Radioplanes, LLC (“Swift Radioplanes”) warrants to the original purchaser that the Lynx UAS (the “Product”) and any variant thereof will be free from defects in materials and workmanship. All Products are checked before they are sent out. In the unlikely event that the Product is faulty, it must be returned to Swift Radioplanes within 60 days of receipt, providing that no alterations have been made beyond that necessary for evaluation and has no physical damage. Manufacturing defects identified during that period will be repaired by Swift Radioplanes or replaced with the same item. Swift Radioplanes will not accept goods that have been clearly used more than the amount needed to evaluate their functionality. Additionally, Swift Radioplanes will not accept warranty claims after the purchaser has flown the Product due to the inherent risk involved with such operations.
What is Not Covered
This warranty is not transferable and does not cover (i) cosmetic damage, (ii) damage due to acts of God, accident, misuse, abuse, negligence, commercial use, or due to improper use, installation, operation or maintenance, (iii) modiﬁcation of or to any part of the Product, (iv) Product not purchased from an authorized Swift Radioplanes dealer, or (v) Product not compliant with applicable technical regulations.
OTHER THAN THE EXPRESS WARRANTY ABOVE, SWIFT RADIOPLANES MAKES NO OTHER WARRANTY OR REPRESENTATION, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE PURCHASER ACKNOWLEDGES THAT THEY ALONE HAVE DETERMINED THAT THE PRODUCT WILL SUITABLY MEET THE REQUIREMENTS OF THE PURCHASER’S INTENDED USE.
Swift Radioplanes’s sole obligation and the purchaser’s sole and exclusive remedy shall be that Swift Radioplanes will, at its option, either (i) service, or (ii) replace, any Product determined by Swift Radioplanes to be defective. Swift Radioplanes reserves the right to inspect any and all Product(s) involved in a warranty claim. Service or replacement decisions are at the sole discretion of Swift Radioplanes. Proof of purchase is required for all warranty claims. SERVICE OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE PURCHASERS SOLE AND EXCLUSIVE REMEDY.
Limitation of Liability
SWIFT RADIOPLANES SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR PRODUCTION OR COMMERCIAL LOSS IN ANY WAY, REGARDLESS OF WHETHER SUCH CLAIM IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, EVEN IF SWIFT RADIOPLANES HAS BEEN ADVISED OF SUCH DAMAGES. Further, in no event shall the liability of Swift Radioplanes exceed the individual price of the Product on which liability is asserted. As Swift Radioplanes has no control over use, setup, ﬁnal assembly, modiﬁcation or misuse, no liability shall be assumed nor accepted for any resulting damage or injury. By the act of use, setup or assembly, the user accepts all resulting liability. If you as the purchaser or user are not prepared to accept the liability associated with the use of the Product, purchaser is advised to return the Product immediately in new and unused condition to the place of purchase.
These terms are governed by Arizona law (without regard to conﬂict of law principals). This warranty gives you speciﬁc legal rights, and you may also have other rights which vary from state to state. Swift Radioplanes reserves the right to change or modify this warranty at any time without notice.
Although the utmost care has been taken to ensure the accuracy of the information published on the Swift Radioplanes website, including their content and function, ANY CONTENT IS PROVIDED “AS IS” TO THE FULLEST EXTENT PERMITTED BY LAW.
All products are shipped using standard published carrier rates and policies. No “handling” fees or markup of shipping charge will be added by Swift Radioplanes. FedEx Ground and International Air Economy shipping will normally be used unless otherwise requested by the purchaser.
Lynx and support equipment will ship in their respective Pelican transport cases. Additional packaging may be added for transit.
Lynx is a sophisticated Product and not a toy. It must be operated with caution and common sense. As the end user of the Product, you are solely responsible for operating in a manner that does not endanger yourself and others or result in damage to the Product or the property of others. As Lynx is controlled by a radio signal, it may be subject to interference from many sources outside your control.
- Avoid flights over populated areas, open-air assembly of people, and heavily trafficked roads
- Avoid flights with proximity to any airport or heliport
- Avoid flights higher than 400 ft AGL
- Avoid operations beyond line-of-sight
- Adhere to any directions, warnings, limitations, and pre-flight steps for Lynx and support equipment (chargers, battery packs, etc.)
- Avoid water exposure to any equipment not speciﬁcally designed and protected for this purpose
- Check current weather conditions before each flight
- Check battery voltage levels before each flight (flight pack, transmitter, laptop, etc.)
- Keep transmitter powered on while Lynx is powered
- Keep moving parts clean
- Ensure the throttle safety key is installed before powering Lynx
- Always avoid the propeller arc while Lynx is powered
- Ensure failsafes are properly set before ﬂying
- Inspect Lynx before and after every flight
- Never operate Lynx with damage to the airframe or components
